They got terrible srvice, so didn't tip and were arrested for it. Your laws suck.

Well, it had to come to a head sometime. Hopefully this will put paid to the whole mandatory gratuity thing. I have several times said to the staff at restaurants that had a "mandatory" gratuity that I would only be dining there if it was understood that the tip was at my discretion. Once I was refused service, and twice they gave in and said fine, it's not mandatory for you. If they want 18% more then charge 18% more, and call it a service fee, not a gratuity. Otherwise it is disingenuous and tantamount to bait and switch.

There's no law that mandates you pay gratuity. And typically, for restaurants that implement this policy, the text "for parties of 6 of more will be automatically charged an 18% gratuity" is on every menu.

Now, the law's pretty clear in that you are expected to pay for what you consume.

Now, the idea that a restaurant can automatically charge a fee regardless of their service quality is ethically absurd. The law protects it because it's made apparent to the customer....the same way it's made apparent for every other item on that menu.

And I feel as if you didn't read the article you posted. If you did, you would have read "it is doubtful the charges will hold up in front of a judge."

Police make shitty arrests all the time. Blame their shittiness and blame the shittiness of the restaurant.

I do have a gripe about the arrest. Why was the couple arrested, and not the other 6 people. I believe they all ate the food they didn't (completely) pay for.

When I was waiting tables I had a table of about 15 walk out on my tab after eating all the food.

My manager called the cops and they were pulled over. Luckily for these tourists, the cop gave them the option of coming back and paying.

I'll admit, my service was SHITTY. I was overloaded on tables and other servers were taking my orders.

Shitty service aside, you pay the bill for what you eat, and tip the waiter accordingly based on their service.

Law is not equal to police fuckups. This is one of the many reasons people are found NOT GUILTY in a court of law. It's like when you stop at a stop sign and a cop for some reason thought you ran it and gives you a ticket.

Is this really that hard to get?
